Terms of Service — Sukii Community

Welcome to Sukii Community. These Terms of Service ("Terms") are an agreement between you and Advervia Advertising Agency ("Advervia," "we," "us," "our"), the operator of the Sukii Community product listing platform ("Sukii," the "Platform"). By accessing Sukii, registering as a Seller or Buyer, or completing an order, you agree to these Terms. If you do not agree, please do not use the Platform.

1. About Sukii — a product listing platform with in-platform payment

Sukii is a local sellers community listing platform that helps Capiznon sellers publish products online and reach local buyers, tourists, and overseas kababayan. Unlike a purely directory-style service, Sukii does process buyer payment for orders placed through the Platform: Buyers pay online, in-platform, via our payment processor PayMongo; Sukii collects that payment and remits the Seller's share, less Sukii's platform fee, according to Section 8. Sukii does not itself manufacture, hold inventory of, ship, or guarantee any product — those remain the Seller's responsibility.

2. Definitions

  • Seller — a business that has registered on Sukii under Sukii Libre or Sukii Tampok.
  • Buyer — anyone who browses listings or places an order through Sukii.
  • USID — a Seller's Unique Seller ID, issued when their account is created.
  • Listing — a product or service a Seller publishes on the Platform.
  • Order — a Buyer's purchase of one or more Listings, paid in-platform via PayMongo.
  • Platform Fee — the percentage Sukii deducts from each successful Order (see Section 8).
  • Content — information, photos, and other materials submitted to the Platform.

3. Eligibility

To register as a Seller you must be at least 18 years old, operate a legitimate business, and provide a valid DTI Business Name registration and a government-issued ID whose name matches your business registration. You agree that all information you provide is true, current, and complete, and that you have the authority to register the business.

4. Your account & USID

Your USID identifies your Seller account and is used to sign in to the Seller Portal. Keep your sign-in link confidential. You are responsible for activity under your account. Notify us promptly of any unauthorised use.

5. Tiers & platform fees

  • Sukii Libre — ₱0 forever, an 18% platform fee on each successful sale, up to 30 active listings.
  • Sukii Tampok — ₱399/month, a 10% platform fee on each successful sale, unlimited active listings and priority placement.
  • Current tier pricing is described on our Pricing page and forms part of these Terms.
  • Sukii Tampok's monthly fee is billed via PayMongo. If a renewal payment is not completed, your account may be downgraded to Sukii Libre after a short grace period, as described on the Pricing page.

6. Verification & account status

We may review submitted documents to support community trust. We may approve, request more information, decline, or later suspend a Seller account if information is inaccurate, cannot be verified, is ineligible, or violates these Terms. Verification supports trust but is not a guarantee of any Seller's products, conduct, or business outcomes (see our Disclaimer).

7. Seller responsibilities

  • List only lawful products and services you are authorised to sell, with accurate descriptions, pricing, and photos.
  • Fulfil accepted Orders — pack, prepare, and deliver or make available for pickup as described in your listing.
  • Respond to Buyers promptly and handle your own after-sales support.
  • Keep your listings and contact information up to date.
  • Comply with all applicable laws, including consumer, tax, and business-permit requirements.

8. Orders, payment & the platform fee

When a Buyer places an Order, payment is collected by Sukii through PayMongo on the Seller's behalf. Sukii deducts its Platform Fee (18% Sukii Libre / 10% Sukii Tampok) from the Order total and remits the remaining amount to the Seller. Payouts are batched and settled on a recurring schedule described in the Seller Portal, not instantly per Order — this lets us verify each Order before funds move. Sukii is not a bank or e-money issuer; funds are held only briefly, for the purpose of completing settlement between Buyer and Seller.

9. Buyer responsibilities

Buyers agree to provide accurate order and contact information, pay the listed price at checkout, and communicate directly with the Seller for order-specific questions (size, customization, pickup arrangements, etc.) via the in-platform chat.

10. Prohibited items & conduct

You may not use Sukii to offer or promote illegal, counterfeit, stolen, recalled, or unsafe goods; regulated items you are not licensed to sell (e.g. firearms, drugs, certain wildlife, or financial schemes); adult or exploitative content; or anything that infringes others' rights. You may not post false information, impersonate others, harass the community, scrape or misuse data, attempt to disrupt the Platform, or use Sukii to defraud Buyers or Sellers. We may remove content and suspend accounts that breach this section.

11. Content & intellectual property

You retain ownership of the original Content you submit (such as your business details and product photos). By submitting it, you grant Advervia a non-exclusive, royalty-free, worldwide licence to host, display, resize, and use that Content to operate and promote your listing and the Platform. You confirm you own or have the rights to everything you submit and that it does not infringe any third party. The "Sukii" name, logo, and platform are owned by Advervia and may not be copied or used without permission.

12. Refunds, disputes & delivery issues

Because Sukii processes payment but does not fulfil, ship, or inspect any product, Sellers remain solely responsible for the quality, safety, legality, and delivery of what they sell. Refund eligibility for a specific Order is described in our Refund & Cancellation Policy. Sukii facilitates communication between Buyer and Seller to resolve issues but is not a guarantor of any transaction outcome.

13. Third-party services

Sukii relies on third-party services including PayMongo (payments), Google Workspace (hosting of forms, files, and data), Firebase (in-app chat and notifications), and Meta/Facebook (Messenger contact links). Your use of those services is also subject to their own terms and policies.

14. Suspension & termination

We may suspend or terminate a Seller or Buyer account for breach of these Terms, non-payment of Sukii Tampok fees, fraud, or conduct that harms the community, with or without notice depending on severity. You may stop using Sukii at any time; amounts already owed are settled under Section 8 and our Refund & Cancellation Policy.

15. Disclaimers & limitation of liability

Sukii is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Advervia is not liable for indirect, incidental, or consequential losses, or for losses arising from a Seller's products or fulfillment, or from third-party services. Our total liability for any claim relating to the Platform will not exceed the Platform Fees collected from the transaction giving rise to the claim, or the Sukii Tampok fees you paid in the twelve (12) months before the event giving rise to the claim, whichever applies. Nothing here limits liability that cannot be limited by law, including your non-waivable rights under the Consumer Act (RA 7394). Please also read our Disclaimer.

16. Indemnification

You agree to indemnify and hold Advervia harmless from claims, losses, and expenses arising out of your Content, your products or services, your dealings with the other party to an Order, or your breach of these Terms or of any law.

17. Privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.

18. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above shows the current version. Material changes will be posted on this page; continued use after changes means you accept them.

19. Governing law & venue

These Terms are governed by the laws of the Republic of the Philippines. Any dispute that cannot be resolved amicably shall be submitted to the proper courts of Roxas City, Province of Capiz, to the exclusion of other venues, without prejudice to applicable consumer-protection forums.
